If you are someone who operates within the criminal justice system, then you should absolutely know about all six of these groundbreaking bail studies and their findings.<\/p>\n<h2>The Six Landmark Bail Studies<\/h2>\n<ol>\n<li><strong><a href=\"\/bail\/bail-studies\/\">Cohen &amp; Reaves (2007)<\/a> \u2013 Bureau of Justice Statistics (BJS), &#8220;Pretrial Release of Felony Defendants in State Courts, 1990\u20132004&#8221;<\/strong> The most comprehensive national study, analyzing felony cases from the 75 largest U.S. counties over 15 years. Financially secured surety bonds had the lowest FTA rate at <strong>18%<\/strong>, compared to <strong>26%<\/strong> for release on recognizance (ROR) and <strong>30%<\/strong> for unsecured releases through pretrial services agencies. Surety bonds also showed the highest fugitive recovery rates (only 3% remained at large after one year vs. 8\u201310% for others).<\/li>\n<li><strong><a href=\"\/bail\/bail-studies-part-2-helland-tabarrok-the-fugitive\/\">Helland &amp; Tabarrok (2004)<\/a> \u2013 &#8220;The Fugitive: Evidence on Public Versus Private Law Enforcement from Bail Jumping,&#8221; <em>Journal of Law &amp; Economics<\/em><\/strong> A highly regarded peer-reviewed economic analysis using national data and controls for defendant characteristics. Defendants released on surety bonds were <strong>28% less likely<\/strong> to fail to appear than similar defendants released on their own recognizance. If they did FTA, they were <strong>53% less likely<\/strong> to remain at large for extended periods, highlighting the private enforcement incentives (bondsmen and bounty hunters).<\/li>\n<li><strong><a href=\"\/bail\/bail-studies-part-3-dr-robert-morris\">Morris (2013\/2014) \/ Clipper, Morris &amp; Russell-Kaplan (2017)<\/a> \u2013 Dallas County, Texas Pretrial Release Study (published in <em>PLOS ONE<\/em>)<\/strong> Analysis of all ~22,000\u201329,000 pretrial releases in Dallas County in 2008, using propensity score matching to compare similar defendants across bond types. Commercial surety bonds had significantly lower FTA\/forfeiture rates than cash bonds, attorney bonds, and pretrial services releases. For felonies, defendants on bail bonds were estimated to be 39\u201356% more likely to appear in court. The study also quantified taxpayer savings from reduced court inefficiencies.<\/li>\n<li><strong><a href=\"\/bail\/part-4-dr-michael-block-the-effectiveness-and-cost-of-secured-vs-unsecured-release\/\">Block (2005)<\/a> \u2013 &#8220;The Effectiveness and Cost of Secured and Unsecured Pretrial Release in California\u2019s Large Urban Counties: 1990\u20132000&#8221;<\/strong> Examination of BJS data from major California counties. Surety bonds produced a <strong>20.1%<\/strong> FTA rate, compared to <strong>31.8%<\/strong> for combined ROR\/conditional release. The author estimated that shifting a modest percentage of cases to surety bonds could substantially reduce FTAs and associated costs.<\/li>\n<li><span data-teams=\"true\"><strong><a href=\"\/bail\/part-5-reisig-2023-yolo-countys-zero-bail-study\/\">Reisig \/ Yolo County District Attorney\u2019s Office (2023)<\/a> \u2013 \u201cZero Bail vs. Posted Bail Study\u201d (Yolo County District Attorney\u2019s Office)<\/strong> A key comparative analysis of matched random samples of 100 arrestees each showing that individuals released on zero bail had substantially higher recidivism rates (78% vs. 46% re-arrest rate over 18 months) and committed 163% more total new crimes\u2014including 200% more violent offenses\u2014than those released after posting traditional bail. It positioned posted bail as significantly more effective than zero-bail policies for reducing reoffending and protecting public safety.<\/span><\/li>\n<li><strong><a href=\"\/bail\/part-6-harris-county-court-watch-study-the-cost-of-free-pretrial-release\">Houston Police Officers&#8217; Union Pretrial Report on Harris County, Texas (2022)<\/a> &#8211; <\/strong>Houston Police Officers\u2019 Union released a report on pretrial release results in Harris County, Texas following significant reforms to the county&#8217;s pretrial release process. \u00a0The data is presented through a website, <strong>Harris County Court Watch,<\/strong> and has produced some of the most troubling real-world data on pretrial release outcomes in the country. The \u00a0tracking of Harris County misdemeanor courts shows a staggering <strong>81.6% failure-to-appear (FTA) rate<\/strong> \u2014 meaning only <strong>18.4%<\/strong> of defendants are actually showing up for their scheduled court dates. These numbers, drawn directly from official court records, paint a clear picture: the heavy reliance on unsecured \u201cfree\u201d releases (primarily personal recognizance bonds with little to no financial stake) is not working.<\/li>\n<\/ol>\n<h2><img loading=\"lazy\" class=\"image-padding alignright wp-image-13023\" src=\"https:\/\/www.aiasurety.com\/bail\/wp-content\/uploads\/2026\/05\/Bail-studies-1-1.jpg\" alt=\"\" width=\"439\" height=\"261\" srcset=\"https:\/\/www.aiasurety.com\/bail\/wp-content\/uploads\/2026\/05\/Bail-studies-1-1.jpg 1200w, https:\/\/www.aiasurety.com\/bail\/wp-content\/uploads\/2026\/05\/Bail-studies-1-1-300x179.jpg 300w, https:\/\/www.aiasurety.com\/bail\/wp-content\/uploads\/2026\/05\/Bail-studies-1-1-1024x609.jpg 1024w, https:\/\/www.aiasurety.com\/bail\/wp-content\/uploads\/2026\/05\/Bail-studies-1-1-768x457.jpg 768w\" sizes=\"(max-width: 439px) 100vw, 439px\" \/>Why These Six Studies Matter<\/h2>\n<p>Debates surrounding bail reform, pretrial release and public safety are often driven by opinions, politics and isolated anecdotes. The purpose of this series is to focus on the data. The six studies featured here represent some of the most significant research ever conducted on court appearance rates, public safety outcomes and the effectiveness of financially secured release.<\/p>\n<p>Collectively, these studies span more than three decades and include national datasets, peer-reviewed economic research, large urban county analyses and real-world bail reform experiments. While each study examines different jurisdictions and populations, they consistently provide valuable insight into what happens when defendants are released before trial.<\/p>\n<p>Whether you are a policymaker, researcher, journalist, criminal justice professional or member of the public, these studies offer an evidence-based foundation for understanding the ongoing debate surrounding bail, pretrial release and public safety.<\/p>\n<p>All of these studies conclude that the financial incentives for defendants, bondsmen, and sureties are the key driver of higher appearance rates and better fugitive recovery. They draw on large-scale government data (e.g., BJS), peer-reviewed analysis with statistical controls like propensity score matching, and jurisdiction-specific datasets. They generally report lower raw or adjusted <a href=\"https:\/\/www.aiasurety.com\/bail\/accountability-matters-a-simple-text-is-not-enough-to-keep-us-safe\/\">FTA rates<\/a> and better fugitive recapture for surety bonds.<\/p>\n<p>Additionally, these six studies are also the most frequently cited as demonstrating that pretrial release on a financially secured surety\/commercial bail bond is the most effective at ensuring defendants appear in court (i.e., lowest failure-to-appear or FTA rates), compared to own recognizance (OR\/ROR), unsecured bonds, cash bonds, attorney bonds, or pretrial services agency releases.<\/p>\n<p>Over the next 2-3 weeks we will post a 6-part series on these fact filled and authoritative studies.
